Terms of Service

Welcome to Tonevault! These Terms of Service (“Terms”) govern your use of the Tonevault website at tonevault.io (the “Service”). By creating an account or using Tonevault, you agree to these Terms.

1. Who We Are

Tonevault is an independent community platform for sharing Line 6 Helix guitar presets. The Service is operated by an individual (“we,” “us,” or “our”).

2. Eligibility

You must be at least 13 years old to use Tonevault. By creating an account, you confirm that you are 13 or older. If we learn that a user is under 13, we will delete their account and data promptly.

3. Your Account

You sign in to Tonevault using your Google account. You are responsible for all activity under your account. You may not share your account or use Tonevault to impersonate anyone.

4. Your Content

Preset files: When you upload a preset file (.hlx, .hsp), you retain full copyright ownership. By uploading, you grant Tonevault a non-exclusive, worldwide, royalty-free license to host, store, display, and serve your preset to other users of the Service for as long as the file remains on the platform.

Comments and other platform content: Comments, ratings, and other interactions you contribute to the platform are part of the community experience. By posting this content, you grant Tonevault a worldwide, royalty-free, irrevocable, sublicensable license to use, display, reproduce, and distribute it as part of operating the Service.

Your responsibility: You are solely responsible for all content you submit. You agree not to upload or post content that:

• Infringes on anyone’s copyright, trademark, or other intellectual property rights
• Contains malware, viruses, or harmful code
• Is illegal, harassing, defamatory, or violates anyone’s privacy
• Impersonates another person or entity

We reserve the right to remove any content that violates these Terms, without prior notice.

5. Copyright and DMCA

Tonevault respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA).

If you believe content on Tonevault infringes your copyright, send a takedown notice to tonevault@ft.io that includes:

• Your contact information (name, address, phone number, email)
• A description of the copyrighted work you believe has been infringed
• The URL of the allegedly infringing content
• A statement that you have a good faith belief the use is not authorized by the copyright owner
• A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on their behalf
• Your physical or electronic signature

If your content was removed and you believe this was in error, you may send a written counter-notice to tonevault@ft.io. We will restore the content unless the original complainant seeks a court order. Repeat infringers will have their accounts terminated.

6. Prohibited Conduct

You agree not to:

• Use bots, scrapers, or automated tools to access or collect data from Tonevault without our permission
• Attempt to access accounts, systems, or data you are not authorized to access
• Interfere with or disrupt the Service or its infrastructure
• Use Tonevault for commercial purposes (e.g., selling presets, advertising) without our written permission
• Reverse engineer or attempt to extract source code from the Service

7. Account Termination

We may suspend or terminate your account at any time, with or without notice, if you violate these Terms or engage in conduct harmful to the community. If your account is terminated or you delete it yourself, your profile and login access will be removed. Your uploaded presets and public content will remain on the site attributed to a deleted account, unless you delete them yourself before account removal.

You may delete your account at any time from your account settings.

8. Disclaimer of Warranties

Tonevault is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the Service will be available at all times, error-free, or that your content will always be accessible. We may modify, suspend, or discontinue the Service at any time, with or without notice.

Guitar presets are provided by community members and are not tested or endorsed by Tonevault. Always test presets at low volume before use.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Tonevault and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, equipment damage, or lost profits—even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed $100 USD.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service will be resolved in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and may post a notice on the site. Your continued use of Tonevault after changes take effect means you accept the revised Terms.
